Important Notes & Terms of Service

1. Our Role and Scope of Service

Right Pathway operates as an RPL facilitation and support service. We are not a Registered Training Organisation (RTO). Our role is to help applicants understand RPL pathways, organise their evidence portfolios, and facilitate introductions to our network of partner RTOs.

The partner RTO retains complete authority over the assessment process, the evaluation of evidence, and the final decision regarding competency. Qualifications are issued solely by the relevant partner RTO where all competency requirements are met.

2. Fees and Free Services

Free Eligibility Check: There is absolutely no charge for the initial skills and eligibility assessment.

Service Fees: If you choose to proceed with our facilitation services after the free check, an agreed fee or deposit is required before evidence collection, portfolio preparation, and RTO submission services commence.

3. Cancellation and Refund Policy

We are committed to providing fair and transparent services in accordance with Australian Consumer Law. You have the right to cancel a service contract if there is a major problem that cannot be fixed within a reasonable timeframe.

Refunds are generally approved when:

• Right Pathway is unable to deliver the facilitation service for which you have paid.
• You have been overcharged due to a billing error.
• The service is not delivered within a reasonably agreed timeframe due to faults wholly attributed to Right Pathway.

Refunds are generally not available for:

• Change of mind or incorrect pathway choice after services have commenced.
• Financial hardship.
• An employer, licensing body, or organisation not accepting a specific nationally recognised qualification.
• An unwillingness or inability to provide the required evidence or comply with the assessing RTO's requirements.
• Voluntary withdrawal from the process.

4. Candidate Protection Insurance

To provide peace of mind, a Candidate Protection Insurance fee ($200) applies at enrolment. This protects your investment during the third-party assessment phase.

What is covered:

• If the assessing partner RTO ceases operations before your assessment is completed.
• If the partner RTO's registration is revoked by the Australian Skills Quality Authority (ASQA).

In these events, you are entitled to:

• A transfer to another partner RTO to complete your qualification at no extra cost, OR
• A 70% refund of your course fees if no alternative provider is available for that specific qualification.

5. Licensing, Migration, and Employment Outcomes

Nationally recognised qualifications issued by partner RTOs are valid under the Australian Qualifications Framework (AQF). However, Right Pathway does not guarantee that a qualification will result in a specific employment outcome, migration visa, or industry licence.

Industry licensing requirements change frequently and vary by state and territory. It is the sole responsibility of the applicant to contact their relevant state licensing body or migration agent to ensure the target qualification meets their specific external requirements.

6. Privacy and Personal Information

Right Pathway collects personal information submitted through our eligibility assessment form and other contact channels for the purpose of assessing RPL pathway suitability and providing facilitation services.

Personal information is handled in accordance with the Australian Privacy Act 1988 (Cth). We do not sell or share personal information with third parties except where required to facilitate the RPL process with our partner Registered Training Organisations, or where required by law.
